(E) SAME — EXCEPTION FOR CERTAIN SUPERVISED,
UNLICENSED INDIVIDUALS.

AN UNLICENSED INDIVIDUAL WHO ACTS UNDER § 7-102(B)(3)
OF THIS TITLE MAY USE THE WORD "NURSING" TOGETHER WITH
ANOTHER WORD TO DESCRIBE THE OCCUPATION OF THE INDIVIDUAL,
AS IN PHRASES SUCH AS "NURSING AIDE" AND "NURSING
ASSISTANT".

REVISOR'S NOTE: This section is new language derived in
part from the last clause of the second sentence
of Art. 43, § 290 and the second sentence of §
291(d) and from Art. 43, §§ 295(e), 296(f), and
301(a)(4) and (5). This section is revised in
the standard language used throughout this
article to express a prohibition against false
representations of authority to practice a health
occupation.

As to subsection (d) of this section, the present
law prohibits a person from using the term
"licensed practical nurse" if the person is not
authorized to practice licensed practical nursing
under this title. The General Assembly may wish
to expand this prohibition to include the similar
term "practical nurse".

The balance of the second sentence of Art. 43, §
290 now appears in § 7-701 of this subtitle.

For a similar provision with regard to licensed
nurse midwives, see § 7-608 of this title.

7-704. SELLING FRAUDULENT RECORDS, DIPLOMAS, OR LICENSES.

A PERSON MAY NOT SELL, FRAUDULENTLY OBTAIN,
FRAUDULENTLY PROVIDE, OR FRAUDULENTLY AID OR ABET THE SALE,
FRAUDULENT OBTAINMENT, OR FRAUDULENT PROVISION OF ANY
RECORD, NURSING DIPLOMA, LICENSE, OR LICENSE RENEWAL.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
301(a)(1).

7-705. PRACTICING WITH FRAUDULENT RECORD, DIPLOMA, OR
LICENSE.

(A) PRACTICE REGISTERED NURSING.

A PERSON MAY NOT PRACTICE REGISTERED NURSING UNDER
COLOR OF ANY DIPLOMA, LICENSE, OR RECORD THAT IS:

(1) ILLEGALLY OR FRAUDULENTLY OBTAINED; OR

(2) SIGNED OR ISSUED UNLAWFULLY OR BY FRAUDULENT
REPRESENTATION.
