of Art. 43, § 85.

7-610. PROHIBITION AGAINST LICENSED NURSE MIDWIFE ATTENDING
ABNORMAL CHILDBIRTH.

EXCEPT UNDER THE PERSONAL DIRECTION AND SUPERVISION OF
A PHYSICIAN, A LICENSED NURSE MIDWIFE MAY NOT ATTEND A WOMAN
IN AN ABNORMAL CASE OF CHILDBIRTH.

REVISOR'S NOTE: This section is new language derived in
part from the first sentence of Art. 43, § 87.

The introductory phrase "{e}xcept under the
personal direction and supervision of a
physician" is derived from present Art. 43, § 84
and used here to clarify that in an abnormal case
of childbirth a licensed nurse midwife has the
same scope of action as an unlicensed person.
This addition is called to the attention of the
General Assembly.

For the corresponding license scope limitation
see § 7-604 of this subtitle.

7-611. SCOPE OF PREVIOUS LAW.

A LICENSED NURSE MIDWIFE WHO WAS GOVERNED BY THE LAW
THAT REGULATED MIDWIVES ON OR BEFORE JULY 1, 1978 REMAINS
GOVERNED BY THAT LAW UNTIL RULES AND REGULATIONS TO REGULATE
THESE LICENSEES ARE ADOPTED BY THE BOARD AND TAKE EFFECT.

REVISOR'S NOTE: This section is new language derived in
part from the second sentence of Art. 43, § 86(a)
and from Art. 43, § 86(e).

The Commission to Revise the Annotated Code
recommends that the General Assembly consider
deleting this section and transferring to the
Board the jurisdiction over those midwives who
were licensed on or before July 1, 1978. Under
the present law, approximately 120 individuals
licensed as midwives on or before July 1, 1978
are governed by the Secretary under the "old" law
while the individuals licensed as midwives after
July 1, 1978 are governed by the Board under the
"new" law.

GENERAL REVISOR'S NOTE:

The present law that relates to midwives, Art. 43, §§
82 through 93 addresses "traditional midwives" in addition
to specially qualified registered nurses. However, as of
1980, there were no individuals qualified to be or to become
"traditional midwives". Consequently, the remaining entity
