public from or at the marina or boat basin and in or on the
buildings, piers, and structures constructed by the
commission.

13-6.1. Authority, terms, conditions, etc., for transfer of
operation and facilities.

(a) The Maryland-National Capital Park and Planning
Commission may furnish to the United States of America new
assurances of local cooperation as required by the Act of
Congress approved May 17, 1950, 81 Stat. 516, and other
applicable federal law, and to that end may contract with
the United States of America with regard to such
cooperation, with regard to the maintenance and operation of
the marina and boat basin in Prince George's County which
was constructed pursuant to this Act of Congress. Following
execution of such assurances, and acceptance thereof by the
Secretary of the Army, the Washington Suburban Sanitary
Commission may deed and transfer to the Maryland-National
Capital Park and Planning Commission the marina and boat
basin operation in Prince George's County which was
established by chapter 618 of the Acts of 1959, including
all rights, titles and interests which it may have in the
marina and boat basin, together with all improvements and
facilities constructed on and at the marina, pursuant to the
provisions of chapter 618 of the Acts of 1959. The
Maryland-National Capital Park and Planning Commission shall
accept the transfer of the marina and the boat basin
operation in Prince George's County, and it shall thereupon
assume all responsibility for its administration,
maintenance and operation, including the responsibility for
dredging activities as required by the Act of Congress
approved May 17, 1950, 81 Stat. 516; provided that the
marina and boat basin, and the facilities and appurtenances
thereto, shall have been fully dredged and otherwise
rehabilitated and restored to satisfactory operating
condition by the Washington Suburban Sanitary Commission,
pursuant to chapter 531 of the Acts of 1959, prior to
conveyance to the Maryland-National Capital Park and
Planning Commission; provided further, that prior to
conveyance to the Maryland-National Capital Park and
Planning Commission, the sufficiency of the operating
condition of [said] THE marina and boat basin, and
facilities and appurtenances thereto, shall be certified as
proper and acceptable by the Prince George's County Council
with the advice of the task force, convened in response to
House Joint Resolution 75 of the 1975 General Assembly; and
provided further that the Corps of Engineers - Department of
the Army shall agree to accept the designation of the
Maryland-National Capital Park and Planning Commission,
pursuant to the Act of Congress approved May 17, 1950, 81
Stat. 516, as the organization to contract and cooperate
with the federal government insofar as the marina and boat
basin are concerned (and not with respect to other
agreements and projects for flood control and navigation in
the valleys of the Anacostia River and tributaries within
Prince George's County, as between the Washington Suburban
