the Board to regulate under its rulemaking power
in § 7-205 of this title.

7-311. REINSTATEMENT.

THE BOARD SHALL REINSTATE THE LICENSE OF A FORMER
LICENSEE WHO HAS FAILED TO RENEW THE LICENSE FOR ANY REASON
IF THE FORMER LICENSEE MEETS THE RENEWAL REQUIREMENTS OF §
7-310 OF THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second
sentence of Art. 43, § 297(d).

The more inclusive clause "meets the renewal
requirements of § 7-310 of this subtitle" is
substituted for the reference to notification and
fee payment to reflect more accurately the
prerequisites for license reinstatement.

This reinstatement provision is extended to
licensed nurse midwives to conform to the
otherwise uniform Board practice in dealing with
licensees.

The first sentence of present Art. 43, § 297(d),
which provides that if a nurse stops practicing
nursing in this State, the nurse is not required
to pay a renewal fee during this inactive period,
is deleted as unnecessary since there is only an
academic distinction between being on inactive
status under this provision and being unlicensed.
An individual in either status may not practice
nursing and does not pay license or renewal fees;
thus, all references to inactive status are
deleted.

7-312. DENIALS, REPRIMANDS, SUSPENSIONS, AND REVOCATIONS —
GROUNDS AVAILABLE; RETURNING LICENSES IF SUSPENDED OR
REVOKED; REINSTATEMENT OF LICENSES.

(A) IN GENERAL.

SUBJECT TO THE HEARING PROVISIONS OF § 7-313 OF THIS
SUBTITLE, THE BOARD MAY DENY A LICENSE TO ANY APPLICANT,
REPRIMAND ANY LICENSEE, OR SUSPEND OR REVOKE THE LICENSE OF
A LICENSEE IF THE APPLICANT OR LICENSEE:

(1)  FRAUDULENTLY OR DECEPTIVELY OBTAINS OR
ATTEMPTS TO OBTAIN A LICENSE FOR THE APPLICANT OR FOR
ANOTHER;

(2)  FRAUDULENTLY OR DECEPTIVELY USES A LICENSE;

(3) HAS HAD A LICENSE OR REGISTRATION FROM ANY
OTHER STATE OR COUNTRY DENIED, SUSPENDED, OR REVOKED;
