In subsection (c)(1), (2), and (3) of this
section, the references to "practicing registered
nursing or licensed practical nursing" are
substituted for the references to "nursing" in
present Art. 43, § 300 in light of the
definitions of "practice registered nursing" and
"practice licensed practical nursing" in § 7-101
of this title.
As to subsection (c)(1), (2), and (3) of this
section, the Commission to Revise the Annotated
Code has interpreted present Art. 43, § 300(a),
(b), and (c) to be exceptions rather than
complete exemptions from this title. There is no
rationale for arguing that an individual who
falls into one of the "exceptions" of Art. 43, §
300(a), (b), and (c) should not be subject to
criminal prosecutions for, e.g., counterfeiting
licenses.
In subsections (c)(3) of this section,
"authorized" is substituted for "legally
qualified" to clarify who is excepted from the
license requirement.
Also in subsection (c)(3) of this section, the
term "state" is substituted for the words
"another state, district or territory of the
United States" in light of the definition of
"state" in § 1-101 of this article.
The first phrase of the first sentence of present
Art. 43, § 290, which refers to the purpose of
this title as safeguarding life and health, is
deleted as unnecessary.

of a license, see § 7-102 of this title.
For the licensing provisions that relate to
licensed nurse midwives, see § 7-602 of this
title.
7-302. QUALIFICATIONS OF APPLICANTS.
(A) IN GENERAL.
EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, TO QUALIFY
FOR A LICENSE OR CERTIFICATION, AN APPLICANT SHALL BE AN
INDIVIDUAL WHO MEETS THE REQUIREMENTS OF THIS SECTION.
(B) EDUCATION — CERTIFIED NURSE PRACTITIONER.
