AN ACT concerning

Motor Vehicles - Implied Warranties

FOR the purpose of providing for an exclusion or
modification from implied warranties for certain motor
vehicles; providing for a form by the Motor Vehicle
Administration containing certain information;

providing for a form by the Motor Vehicle

Administration containing certain information;

prohibiting certain persons from acting on behalf of
buyers of certain motor vehicles; and generally
relating to exclusions or modifications from implied
warranties for certain motor vehicles.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Commercial Law

2-316.1.

(1) The provisions of § 2-316 do not apply to sales of
consumer goods, as defined by § 9-109, services, or both.

(2)  Any oral or written language used by a seller of
consumer goods and services, which attempts to exclude or
modify any implied warranties of merchantability and fitness
for a particular purpose or to exclude or modify the
consumer's remedies for breach of those warranties, is
unenforceable. However, the seller may recover from the
manufacturer any damages resulting from breach of the
implied warranty of merchantability or fitness for a
particular purpose.
