domiciliary or personal care services in a protective
institutional environment to persons who because of advanced
age, or physical or mental disability are not gainfully
employed, or (ii) provide domiciliary care in a protective
institutional or home-type environment to persons who
because of advanced age, or physical or mental disability
are not gainfully employed.] CARE HOMES SHALL MEET THE
DEFINITION OF SUBSECTION (D) OF THIS SECTION AND SHALL
PROVIDE CARE TO PERSONS WHO, BECAUSE OF ADVANCED AGE OR
PHYSICAL OR MENTAL DISABILITY, REQUIRE EITHER DOMICILIARY OR
PERSONAL CARE SERVICES IN A PROTECTIVE ENVIRONMENT.

(f)  "Nonrelated individual" shall mean anyone who is
not a son, daughter, grandson, granddaughter, father,
mother, grandfather, grandmother, brother, sister,
stepmother, stepfather, stepson, stepdaughter, husband or
wife of the owner or lessee, or hot an in-law of any one of
the above persons.

(g)  "Patient" shall mean any individual suffering from
disease or disabilities or any individual who due to
advanced age requires services or care.

(h) "Nursing care" shall mean services    to patients

requested or ordered by physicians and    provided or

supervised by registered or practical nurses     licensed to
practice in the State of Maryland.

(i) "Personal care" shall mean those services which an
individual would normally perform for himself but for which
he is personally dependent on others because of advanced
age, infirmity, physical or mental limitations. Personal
care includes (but is not limited to) assistance in walking,
getting in and out of bed, bathing, dressing, feeding and
general supervision and assistance in daily living.

(j) "Domiciliary care" shall mean those services
provided to aged or disabled persons[, not gainfully
employed,] in a protective institutional or home-type
environment. These services include (but are not limited
to) shelter, housekeeping services, board, facilities and
resources for daily living, personal surveillance or
direction in the activities of daily living.

(k) "Person" shall include any person, partnership,
association or corporation or any State, county or local
governmental unit and any division, board or agency thereof.

(1) "Board" except as otherwise used in §§ 564 and
567, and except where inapplicable, shall mean the Secretary
of Health and Mental Hygiene.

(M) "APARTMENT UNIT" MEANS AN ENCLOSED,
SELF-CONTAINED, LIVING SPACE IN A BUILDING, DESIGNED AND
USED FOR RESIDENTIAL PURPOSES, WHICH HAS AT LEAST TWO SUCH
UNITS.
