In item (5) of this section, the phrase
"additional acts in the practice of registered
nursing" is new language added to clarify that
the Board by itself may authorize licensed
practical nurses to perform "additional acts"
that are within the scope of registered nursing.
This addition is called to the attention of the
General Assembly.
As to item (8) of this section, the present,
specific reporting requirements now appear in §
7-505 of this title.
Item (9) of this section combines the separate
list requirements in present Art. 43, § 90(b), §
294(a)(18), and the fourth sentence of § 294(d).
New language is added to provide for additional
lists if the Board certifies new nursing
specialties.
In item (9)(iii) of this section, the term
"certified" is added to the term "nurse midwives"
to clarify that there is a separate mechanism,
other than the licensing mechanism, for Board
recognition under the additional acts provisions
of this section.
In item (11) of this section, the reference to
referring allegations to the State's attorney is
substituted for the inaccurate reference to the
Board causing the prosecution of violators. See
Art. 10, § 34 of the Code, which provides that
the State's attorney prosecutes for this State.
In item (12) of this section, the phrase "{i}n
accordance with the State budget" is standard
language added to this and, where necessary,
similar provisions in other titles of this
article to clarify that payments out of the
General Fund of this State are subject to the
State budget.
Present Art. 43, § 294(a)(6) and (7), which
refers to the power and duty of the Board " {t}o
examine, license, and renew the licenses of
qualified applicants" and "{t}o conduct
hearings upon charges calling for discipline of a
licensee or denial ... of a license", is deleted
as unnecessary in light of the broader provisions
of §§ 7-304, 7-307, 7-310, and 7-312 of this
title.
