AN ACT concerning

Crimes and Punishments - Assault

FOR the purpose of removing a redundant sentencing provision
for the crime of assault with intent to commit vaginal
intercourse with a person who is under a certain age;
and specifying the sentence for the crime of assault
with intent to commit a sexual offense in certain
degrees.

BY repealing and reenacting, with amendments,

Article 27 - Crimes and Punishments

Section 12

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

12.

Every person convicted of the crime of an assault [with
intent to commit vaginal intercourse with a person who is
under 14 years of age in violation of this article, or] with
intent to rob, is guilty of a felony and shall be sentenced
to imprisonment for not less than two years or more than ten
years. Every person convicted of the crime of an assault
with intent to murder is guilty of a felony and shall be
sentenced to imprisonment for not less than two years nor
more than 30 years. Every person convicted of the crime of
an assault with intent to commit a rape in any degree OR A
SEXUAL OFFENSE IN THE FIRST OR SECOND DEGREE is guilty of a
felony and shall be sentenced to imprisonment for not less
than two years nor more than 15 years.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
