State's Attorney. The annual salary of the administrative
assistant shall be within the discretion of the State's
Attorney, but in no event exceeding [$18,380] $19,677
$19,115 per annum, to be paid by the county on the
certification of the State's Attorney to the county
executive and County Council. The administrative assistant
is not subject to the rules and regulations of the county
merit system, but shall be entitled to all benefits provided
for county employees under the merit system.
(9) The salary of the State's Attorney, the
deputy State's attorney, principal assistant State's
attorney, and the assistant State's attorneys shall be paid
in equal semimonthly installments.
(10) (I) NOTWITHSTANDING THE PROVISIONS OF
PARAGRAPH (1) OF THIS SUBSECTION, AND EXCEPT AS PROVIDED IN
SUBPARAGRAPH (II) OF THIS PARAGRAPH, UNTIL JANUARY 1, 1983,
THE STATE'S ATTORNEY MAY ENGAGE IN THE PRIVATE PRACTICE OF
LAW.
(II) EXCEPT WITHIN THE PERFORMANCE OF HIS
DUTIES AS STATE'S ATTORNEY, THE STATE'S ATTORNEY MAY NOT:
1. APPEAR AS COUNSEL OR REPRESENT
ANY PARTY PROFESSIONALLY BEFORE ANY COURT, BOARD,
COMMISSION, OR AGENCY OF THIS STATE OR ANY COUNTY, BALTIMORE
CITY, BICOUNTY OR MULTICOUNTY AGENCY, OR MUNICIPAL
CORPORATION IN THIS STATE; OR
2. ENGAGE IN THE PRIVATE PRACTICE OF
CRIMINAL LAW.
SECTION 2. AND BE IT FURTHER ENACTED, That if any
provision of this Act or the application thereof to any
person or circumstance is held invalid for any reason, the
invalidity shall not affect the other provisions or any
other application of this Act which can be given effect
without the invalid provisions or application, and to this
end all the provisions of this Act are declared to be
severable.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act
may not be construed to extend or apply to the salary of the
State's Attorney for Prince George's County in office on the
effective date of this Act, but the provisions of this Act
concerning the salary of the State's Attorney for Prince
George's County shall take effect at the beginning of the
next following term of office.
SECTION 2 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
