RESTITUTION AGAINST THE TENANT, SHALL NOT BE CONSIDERED A
JUDGMENT OF RESTITUTION FOR PURPOSES OF PARAGRAPH (2) OF
THIS SUBSECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.

AN ACT concerning

Allegany County - Alcoholic Beverages - Sunday Delivery

FOR the purpose of providing that in Allegany County a
licensed beer wholesaler may deliver draft beer to a
licensed retailer on Sundays; authorizing the
wholesaler and retailer to agree as to a fee to be
charged for the use of equipment provided by the
wholesaler; and providing that the act of furnishing
equipment is not in violation of the enticement law.

BY repealing and reenacting, with amendments, adding to

Article 2B - Alcoholic Beverages

Section 80(a)(1) (D)

Annotated Code of Maryland

(1976 Replacement Volume and 1980 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 2B - Alcoholic Beverages

80.

(a) In the subdivisions enumerated below the hours
during which alcoholic beverages may be sold or delivered to
retail license holders by holders of wholesalers' licenses
are from 6:00 a.m. to midnight, on every day except Sundays
and election days:

(1) Allegany County. HOWEVER, (D)

NOTWITHSTANDING SUBSECTION (A) OF THIS SECTION, IN ALLEGANY
COUNTY, A HOLDER OF A BEER WHOLESALERS' LICENSE MAY DELIVER
DRAFT BEER TO A RETAIL LICENSE HOLDER ON SUNDAYS AND THE
BEER WHOLESALER AND THE RETAILER MAY AGREE ON A FEE TO BE
CHARGES FOR THE USE OF ANY EQUIPMENT PROVIDED BY THE
