2. IF USE OF THE PENNINGTON AVENUE
SANITARY LANDFILL SITE IN BALTIMORE CITY AS A SANITARY
LANDFILL IS TERMINATED BY THE END OF MAY 1, 1981, TO ANY
CONSTRUCTION, RECONSTRUCTION, DEVELOPMENT OR USE OF THOSE
PROPERTIES IN BALTIMORE CITY COMPRISING AND KNOWN AS THE
WOODBERRY QUARRY SANITARY LANDFILL SITE.

(3)  DUE TO VARIANCES IN FLOODPLAIN MEASUREMENTS,
NO NEW RESIDENTIAL PERMIT FOR CONSTRUCTION IN THE JONES
FALLS FLOODPLAIN WITHIN 25 FEET, MEASURED HORIZONTALLY, OF
THE FLOODPLAIN ADJACENT TO THE FLOODPLAIN MAY BE APPROVED OR
ISSUED UNTIL THE FLOOD MANAGEMENT PLAN FOR THE JONES FALLS
IS PREPARED, APPROVED AND IMPLEMENTED UNDER SUBTITLE 9A OF
THIS TITLE.

(4)  REGULATIONS ADOPTED BY THE DEPARTMENT AS
REQUIRED UNDER SUBPARAGRAPH (2) OF THIS SUBSECTION SHALL BE
NULL AND VOID IF THE DEPARTMENT DETERMINES THAT A FLOOD
MANAGEMENT PLAN FOR THE JONES FALLS IN THE PATAPSCO RIVER
HAS BEEN ADOPTED AND IMPLEMENTED.

(b) BY JULY 1, 1982 1983, THE [The] Department, in
cooperation with the subdivisions and the Departments of
State Planning and Agriculture, shall conduct studies of the
watersheds which shall define at least (1) the existing
magnitude and frequency of flood events, (2) the magnitude
and frequency of flood events based on planned development,
and (3) alternative management techniques according to their
effectiveness in controlling floods and minimizing flood
damage. The studies shall address at least the 100-year
flood event.

(d) (1) BY JULY 1, 1983 1984, EACH [Each] subdivision,
in cooperation with the departments of Natural Resources,
State Planning, Agriculture, and other appropriate State
agencies shall prepare a flood management plan based upon an
evaluation of the alternative management techniques and
other findings included in studies conducted under
subsection (b). Each flood management plan shall be
consistent with the purposes and provisions of this
subtitle.

Management techniques may include:

[(1)] (I) (1) Flood control dams;

[(2)] (II) (2) Levees and dikes;

[(3)] (III) (3) Stormwater detention or

retention structures;

[(4)] (IV) (4) Flood warning systems;

[(5)] (V) (5) Public acquisition;
