FOR the purpose of authorizing the Motor Vehicle
Administration to review reserved space parking permits
that it has issued, to determine if eligibility
requirements are being met; authorizing the
Administration to take certain action if eligibility
requirements are not being met; authorizing the
Administration to request review and recommendation by
the Medical Advisory Board under certain circumstances;
prohibiting any person from committing fraud or
misrepresentation when applying for or using a permit
or when certifying certain facts; authorizing the
Administration to refuse to issue a permit or to revoke
a permit under certain circumstances; providing for an
appeal from a decision of the Administration; and
prohibiting persons from parking a vehicle in a
reserved parking space under certain circumstances.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article - Transportation
21-1005.
(a) A person who has a permanent physical disability
may apply to the Administration, on the form that it
requires, for a permit for one reserved parking space:
(1) To be located at the curb, side, or edge of
the roadway of the highway in front of or near his dwelling
house; and
(2) To provide convenience and safety as the
person enters or leaves his vehicle or that of another.
(b) (1) The Administration shall issue the permit:
[(1)] (I) If the applicant is required to use a
wheelchair to move about or if the Administration determines
that the disability is so severe that the applicant would
endure a hardship or be subject to a risk of injury if the
applicant should enter or leave the vehicle at a less
convenient location; and
[(2)] (II) If the Administration determines that
the physical disability is permanent.
