NATURE, AND EXTENT OF ITS PURCHASE AND THE SOURCE, NATURE,
AND EXTENT OF ITS SALES. THE DIVISION SHALL MAINTAIN
ACCOUNTING RECORDS AND PREPARE FINANCIAL STATEMENTS IN
ACCORDANCE WITH GENERALLY ACCEPTED ACCOUNTING PRINCIPLES FOR
ENTERPRISE FUND TYPE ACTIVITIES. SUCH FINANCIAL STATEMENTS
SHALL BE PREPARED BY THE ADMINISTRATION AND BE AVAILABLE FOR
AUDIT PURPOSES NO LATER THAN 60 DAYS AFTER THE END OF EACH
FISCAL YEAR.

THE GENERAL MANAGER OF STATE USE INDUSTRIES SHALL HAVE
THE AUTHORITY TO DETERMINE THE PERSONNEL NEEDS AND
REQUIREMENTS OF STATE USE INDUSTRIES PROGRAMS AND PRODUCT
AND SERVICE INDUSTRIES, AND SHALL HAVE THE APPOINTING
AUTHORITY TO HIRE ALL SUBORDINATE PERSONNEL.

THE BUDGET FOR STATE USE INDUSTRIES SHALL BE INCLUDED
IN THE BUDGET OF THE DEPARTMENT OF PUBLIC SAFETY AND
CORRECTIONAL SERVICES, AND SHALL BE SUBJECT TO NORMAL
LEGISLATIVE REVIEW AND APPROVAL. THE NUMBER OF ITS
POSITIONS SHALL BE INCLUDED WITHIN THE TOTAL MANPOWER
ALLOCATIONS PROVIDED FOR THE DEPARTMENT OF PUBLIC SAFETY AND
CORRECTIONAL SERVICES. FURTHERMORE, ITS POSITIONS SHALL BE
SUBJECT TO THE STATE'S MERIT SYSTEM, WITH THE EXCEPTION OF
THE GENERAL MANAGER OR ANY OTHER POSITION DETERMINED BY THE
SECRETARY OF PERSONNEL, WHO SHALL BE APPOINTED BY THE
SECRETARY OF THE DEPARTMENT, WITH THE APPROVAL OF THE STATE
USE INDUSTRIES ADVISORY COMMITTEE.

AT THE REQUEST OF ANY STATE AGENCY, THE DIVISION MAY
PROVIDE PRISONERS FOR LABOR UPON STATE WORKS PROJECTS, IF IN
THE JUDGMENT OF THE DIVISION, THE PLACEMENT IS EXPEDIENT AND
PROPER. THE PRISONERS SHALL BE PROVIDED FOR A PROJECT ONLY
IF THE REQUESTING AGENCY AGREES TO THE TERMS AND CONDITIONS
SPECIFIED BY THE DIVISION FOR PROVIDING THE PRISONERS.

THE DIVISION POSSESSES ALL POWERS AND AUTHORITY
NECESSARY FOR THE PROPER PERFORMANCE OF ANY DUTY OR FUNCTION
BY THIS SECTION EVOLVING UPON OR REQUIRED OF THE DIVISION.

SECTION 3. AND BE IT FURTHER ENACTED, That Section 12
of Chapter 775 of the Acts of the General Assembly of 1980,
which would transfer Article 27, Section 681 of the Code to
be Article 21, Section 8-204, is superseded by the
provisions of this Act.

SECTION 3 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
