(I) THE NAME THAT APPEARS ON THE LICENSE
OF THAT PERSON; OR
(II) THE NAME OF A PARTNERSHIP IN
ACCORDANCE WITH § 6-401 OF THIS TITLE;
(17) SIGNS AN APPLICATION FOR A FUNERAL
ESTABLISHMENT LICENSE IF THE SIGNER KNEW OR SHOULD HAVE
KNOWN THAT GROUNDS EXISTED FOR WHICH THE FUNERAL
ESTABLISHMENT LICENSE LATER WAS DENIED, SUSPENDED, OR
REVOKED; OR
(18) VIOLATES ANY PROVISION OF THIS TITLE OR OF
THE LAWS RELATING TO CREMATION.
(B) FUNERAL ESTABLISHMENTS.
(1) SUBJECT TO THE HEARING PROVISIONS OF § 6-316
OF THIS SUBTITLE AND PARAGRAPH (2) OF THIS SUBSECTION, THE
BOARD MAY DENY, SUSPEND, OR REVOKE A FUNERAL ESTABLISHMENT
LICENSE FOR ANY OF THE GROUNDS LISTED IN SUBSECTION (A) OF
THIS SECTION.
(2) THE BOARD MAY NOT DENY, SUSPEND, OR REVOKE A
FUNERAL ESTABLISHMENT LICENSE BECAUSE OF A VIOLATION OF A
PROVISION OF THIS TITLE BY AN EMPLOYEE OF THE ESTABLISHMENT,
UNLESS THE EMPLOYEE HAS A PROPRIETARY INTEREST IN THE
BUSINESS THAT IS CONDUCTED FROM THE ESTABLISHMENT.
REVISOR'S NOTE: This section is new language derived
without substantive change from the last clause
of Art. 43, § 351(a), from Art. 43, § 354(a),
(b), and (c)(1) through (14), and the
introductory language of (15), and from Art. 43,
§ 361(g).
In the introductory language of subsection (a) of
this section, the phrase "deny a license to any
applicant" is standard language added to this
and, where necessary, corresponding sections in
other titles of this article to state expressly a
power that presently is only implied — that the
Board may deny a license to an applicant who
violates a disciplinary provision under this
section.
Also as to the introductory paragraph of
subsection (a) of this section and, where
necessary, corresponding sections of other titles
of this article, the reference to the power of
the Board to reprimand a licensee is added to
state specifically a power that is inherent in
the express power to suspend or revoke a license.
