(House Bill 613)
AN ACT concerning
Designated Hazardous Substances - Local Investigations
FOR the purpose of authorizing municipal health officials to
make inspections of designated hazardous waste disposal
facilities; and requiring all health officials who are
delegated inspection authority to make an immediate
inspection, notify the Department of Health and Mental
Hygiene, and to file a certain written report with the
Department of Health and Mental Hygiene upon the
receipt of complaints in any case, certain local health
officials to make inspections and investigations of
certain sites and facilities at which designated
hazardous wastes are disposed; and establishing certain
inspection and investigation procedures.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article - Natural Resources
8-1413.3.
(a) (1) The Department shall make at least monthly
inspections of each facility that is required to have a
permit under § 8-1413.2 of this subtitle.
(2) As to any operating landfill that is
required to have a permit under § 8-1413.2 of this subtitle,
the inspections shall be made at least once a week.
(b) (1) The Department shall record the date and
findings of each inspection made under this section.
(2) These records shall be public records open
for inspection under the provisions of Article 76A of the
Code.
(3) The Department periodically shall publish
and make available to the public a list of dates that each
