AN ACT concerning

Alcoholism and Alcohol Abuse Services - Certification

of Facilities

FOR the purpose of establishing a certification program for
facilities that provide treatment, care, and
rehabilitation for individuals affected by alcoholism
or alcohol abuse; requiring certification of certain
persons under that program; requiring the adoption of
certain rules and regulations; specifying that

facilities providing these services are related

institutions; providing for certain penalities; and
exempting certain organizations from the certification
program.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 2C - Alcoholism

301A.

(A) (1) IN THIS SECTION, "ALCOHOL ABUSE FACILITY"
MEANS ANY FACILITY THAT PROVIDES TREATMENT, CARE, AND
REHABILITATION FOR INDIVIDUALS EXHIBITING THE EFFECTS OF
ALCOHOLISM OR ALCOHOL ABUSE.

(2) "ALCOHOL ABUSE FACILITY" DOES NOT INCLUDE:

(I) THE OFFICE OF A PHYSICIAN WHO TREATS
HIS OWN PATIENTS WITHIN THE SCOPE OF HIS PRACTICE; OR

(II) A HOSPITAL THAT IS LICENSED BY THE
DEPARTMENT OF HEALTH AND MENTAL HYGIENE UNDER ARTICLE 43, §
