(1)  MONITOR THE REDEPOSIT OF SPOIL AND BALTIMORE
COUNTY TRIBUTARY SPOIL WITHIN 5 MILES OF THE
HART-MILLER-PLEASURE ISLAND CHAIN; AND

(2)  HEAR AND DISPOSE OF COMPLAINTS LODGED BY
INDIVIDUALS AFFECTED BY THE REDEPOSIT OF SPOIL AND BALTIMORE
COUNTY TRIBUTARY SPOIL WITHIN 5 MILES OF THE
HART-MILLER-PLEASURE ISLAND CHAIN.

Article 81 - Revenue and Taxes

9.

(a) The following real and tangible personal property
are exempt from assessment and from State, county, and city
ordinary taxation, except as otherwise stated, which
exemptions shall be strictly construed:

(L-4) REAL AND PERSONAL PROPERTY WHICH IS OWNED HELD
BY THE GRANTEE IN INTEREST TO THE HART-MILLER-PLEASURE
ISLAND CHAIN IN BALTIMORE COUNTY, AS DEFINED IN §
5-1202.2(A)(1) OF THE NATURAL RESOURCES ARTICLE, AND IS USED
FOR MAINTAINING THE ISLAND CHAIN AS AN OPEN AREA, ASSISTING
THE STATE IN MAKING PARK AND RECREATIONAL FACILITIES ON THE
ISLAND CHAIN AVAILABLE TO THE PUBLIC FOR RECREATIONAL AND
EDUCATIONAL PURPOSES, AND ACCOMMODATING THE REDEPOSIT OF
SPOIL AND BALTIMORE COUNTY TRIBUTARY SPOIL AT THE ISLAND
CHAIN IN ACCORDANCE WITH §§ 8-1601 THROUGH 8-1602.2 OF THE
NATURAL RESOURCES ARTICLE.

SECTION 2. AND BE IT FURTHER ENACTED, That the passage
of this Act is contingent upon final judicial adjudication

of all litigation which results in removing legal

impediments to the construction of a contained area for the
redeposit of spoil from the excavation of dredging of
Baltimore Harbor at the Hart-Miller Pleasure Island chain in
Baltimore County. Until such time as legal impediments to
such construction are removed, the provisions of this Act
are null and void without the need of further action by the
General Assembly , if on July 1, 1981 any litigation
challenging the construction of a contained area at the
Hart-Miller-Pleasure Island chain is pending in any court,
the effective date of this Act shall be delayed until 30
days after the conclusion of that litigation .

SECTION 3. AND BE IT FURTHER ENACTED, That subject to
the provisions of Section 2, above, this Act shall take
effect July 1, 1981.
