COVENANTS DESCRIBED IN THIS SUBSECTION, OWNERSHIP OF THE
ISLAND CHAIN SHALL REVERT TO THE STATE (TO THE USE OF THE
DEPARTMENT); THE EASEMENT SHALL CEASE;

(4)  THE GRANTEE IN INTEREST SHALL COVENANT TO
ALLOW THE STATE TO ESTABLISH AND MAINTAIN PARK AND
RECREATIONAL FACILITIES ON THE HART-MILLER-PLEASURE ISLAND
CHAIN AND TO ASSIST THE STATE IN MAKING THESE FACILITIES
AVAILABLE TO THE PUBLIC FOR RECREATIONAL AND EDUCATIONAL
PURPOSES;

(5)  THE GRANTEE IN INTEREST SHALL COVENANT TO
ALLOW THE HART-MILLER-PLEASURE ISLAND CITIZENS OVERSIGHT
COMMITTEE ESTABLISHED UNDER § 8-1602.2 OF THIS ARTICLE TO:

(I)  MONITOR THE REDEPOSIT OF SPOIL AND
BALTIMORE COUNTY TRIBUTARY SPOIL AT THE HART-MILLER-PLEASURE
ISLAND CHAIN IN ACCORDANCE WITH § 8-1602.2(C) OF THIS
ARTICLE; AND

(II)  HEAR AND DISPOSE OF COMPLAINTS LODGED
BY INDIVIDUALS AFFECTED BY THE REDEPOSIT OF SPOIL AND
BALTIMORE COUNTY TRIBUTARY SPOIL.

(6)  THE GRANTEE IN INTEREST SHALL COVENANT THAT
IF, DURING ITS OWNERSHIP OF THE LIFE OF ITS EASEMENT TO THE
HART-MILLER-PLEASURE ISLAND CHAIN THE GRANTEE IN INTEREST
CEASES TO EXIST, OWNERSHIP OF THE ISLAND CHAIN SHALL REVERT
TO THE STATE (TO THE USE OF THE DEPARTMENT). THE EASEMENT
SHALL CEASE.

(C) THE COVENANTS DESCRIBED IN SUBSECTION (B) OF THIS
SECTION SHALL RUN WITH OWNERSHIP OF ALL OR ANY OF THE
HART-MILLER PLEASURE ISLAND CHAIN IN BALTIMORE COUNTY.

8-1601.

(A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(1)  "SPOIL" MEANS EARTH, ROCK, SOIL, WASTE
MATTER, MUCK, OR OTHER MATERIAL EXCAVATED OR DREDGED FROM
BALTIMORE HARBOR PROJECTS AND APPROACH CHANNELS.

(2)  "BALTIMORE COUNTY TRIBUTARY SPOIL" MEANS
EARTH, ROCK, SOIL, WASTE MATTER, MUCK, OR OTHER MATERIALS
EXCAVATED OR DREDGED FROM AN APPROVED DREDGING PROJECT IN
ANY OF THE BALTIMORE COUNTY TRIBUTARIES OF THE CHESAPEAKE
BAY.

(3)  "REDEPOSIT" MEANS TO DUMP, SCATTER, POUR, OR
OTHERWISE DEPOSIT SPOIL OR, IF MADE APPLICABLE BY THE
PROVISIONS OF THIS SUBTITLE OR TITLE 5 OF THIS ARTICLE,
BALTIMORE COUNTY TRIBUTARY SPOIL IN A CONFINED MANNER.

(4)  "BALTIMORE HARBOR" MEANS THE WATERWAY WHICH
CONSISTS OF THE TIDAL PORTIONS OF PATAPSCO RIVER AND ITS
