REVISOR'S NOTE: Subsection (a) of this section is new
language added to reflect more accurately the
state of the present law and to conform to the
language used in similar provisions in other
titles of this article.

Subsection (b) of this section is new language
derived without substantive change from the last
sentence of Art. 43, § 359(a) and from the
reference in the second sentence of Art. 43, §
366A(b) to specifically enumerated items not
covered by a pre-need contract.

SUBTITLE 2. STATE BOARD OF MORTICIANS.

6-201. BOARD ESTABLISHED.

THERE IS A STATE BOARD OF MORTICIANS IN THE DEPARTMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, § 339.

It is set forth as a separate section for
emphasis.

The present reference to the number of members of
which the Board is composed is deleted in light
of § 6-202 of this title, which specifically
enumerates who shall be members of the Board.

With the advice of the Board, the name of the
Board is changed for consistency and to reflect
that with few exceptions a single license is now
issued for what previously were the separate
occupations of funeral director and embalmer.

The present phrase "of Maryland" is deleted from
the Board title to avoid the use of the
duplicative terms "Maryland" and "State" and to
correspond with other health occupation board
designations used in this article.

The present language that indicates that the
powers and duties of the Board are prescribed by
the present subtitle entitled "Funeral Directors
and Embalmers" is deleted as unnecessary, since
the powers and duties of the Board are set out
expressly in this title.

6-202. MEMBERSHIP.

(A) COMPOSITION.

(1) THE BOARD CONSISTS OF 12 MEMBERS.
