(Senate Bill 217)

AN ACT concerning

Office on Aging - Guardianship of the Person Advisory Board

FOR the purpose of allowing the Director on Aging to appoint
a Guardianship Advisory Board to assist with
guardianship decision-making; providing for certain
membership of the Board; providing that a Board member
shall be immune from civil liability under certain
conditions; and permitting certain expenses to be paid
to Advisory Board members.

Article 70B - Office on Aging

Section 24

Annotated Code of Maryland

(1978 Replacement Volume and 1980 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 70B - Office on Aging

24.

(A)  THERE IS A GUARDIANSHIP ADVISORY BOARD.

(B)  THE DIRECTOR ON AGING SHALL APPOINT THE MEMBERS OF
THE BOARD, ONE OF WHOM SHALL BE AN ATTORNEY CURRENTLY
ADMITTED TO PRACTICE IN MARYLAND, ONE OF WHOM SHALL BE A
PHYSICIAN ADMITTED TO PRACTICE IN MARYLAND, AND ONE OF WHOM
IS NEITHER AN ATTORNEY NOR PHYSICIAN.

(C)  THE GUARDIANSHIP ADVISORY BOARD SHALL MAY ADVISE
THE DIRECTOR REGARDING THE DIRECTOR'S RESPONSIBILITIES AS
THE GUARDIAN OF PERSONS UNDER SECTION 13-707 OF THE ESTATES
AND TRUSTS ARTICLE.

(D)  THE MEMBERS OF THE GUARDIANSHIP ADVISORY BOARD MAY
NOT RECEIVE ANY COMPENSATION FOR THEIR SERVICES, BUT SHALL
BE REIMBURSED FOR REASONABLE EXPENSES INCURRED IN THE
PERFORMANCE OF THEIR DUTIES AS PROVIDED IN THE STATE BUDGET.

(E)  ANY ADVISORY BOARD MEMBER ACTING IN GOOD FAITH AND
WITHIN THE SCOPE OF HIS DUTIES IS IMMUNE FROM CIVIL
LIABILITY AS A RESULT OF THOSE ACTS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
