BY repealing and reenacting, with amendments,

Section 5-905(c)(2)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article - Natural Resources
5-905.
(c) (2) Subject to the approval of the Department, a
local governing body may use part of its acquisition funds
for initial or periodic updating of recreation and parks
master plans. The amount that may be used by a subdivision
for planning purposes IN THE LOCAL RECREATION AND PARKS
MASTER PLAN shall not exceed [$10,000] $25,000 for any one
fiscal year[, which amount shall be matched by funds from
the subdivision]. LOCAL MATCHING FUNDS ARE NOT REQUIRED FOR
PLANNING OR UPDATING THE LOCAL RECREATION AND PARKS MASTER
PLAN.
SECTION 2. AND BE IT FURTHER ENACTED, Subject to the
approval of the Department of Natural Resources and the
availability of uncommitted Program Open Space funds for
local acquisition, a local governing body submitting which
has initiated development of its Local Recreation and Parks
Master Plan between July 1, 1980 and July 1, 1981 shall be
eligible to use up to $25,000 of its acquisition funds,
without the necessity for local matching funds, for planning
and updating the master plan.
The provisions of this section are not limited by the
prior authorization or payment of Program Open Space local
acquisition funds for planning and updating the Local
Recreation and Parks Master Plan between July 1, 1980 and
July 1, 1981.
A local governing body desiring to take advantage of
this provision shall resubmit its request to use a portion
of its acquisition funds up to $25,000 for the purpose of
planning and updating the Local Recreation and Parks Master
Plan.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
