5-314. REINSTATEMENT OF SUSPENDED OR REVOKED LICENSES.

IF A LICENSE IS SUSPENDED OR REVOKED FOR A PERIOD OF
MORE THAN 1 YEAR, THE BOARD MAY REINSTATE THE LICENSE AFTER
1 YEAR.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
555B-23(c).

The introductory clause is new language added to
clarify that this section applies only to cases
where the initial suspension or revocation is for
a period greater than 1 year.

SUBTITLE 4. ELECTROLOGY EDUCATION PROGRAMS.

5-401. POWERS AND DUTIES OF BOARD.

IN ADDITION TO THE OTHER POWERS AND DUTIES OF THE
BOARD, AS TO ELECTROLOGY EDUCATION PROGRAMS OFFERED IN THIS
STATE, THE BOARD HAS THE POWER AND DUTY TO:

(1)  SET STANDARDS BY WHICH AN ELECTROLOGY
EDUCATION PROGRAM MAY BE APPROVED;

(2)  SURVEY AND EVALUATE PROPOSED PROGRAMS;

(3)  EVALUATE THE NEED FOR A PROGRAM IN THE
GEOGRAPHICAL AREA IN WHICH THE PROGRAM WILL BE LOCATED;

(4)  KEEP A LIST OF INSTITUTIONS THAT CURRENTLY
OFFER ELECTROLOGY EDUCATION PROGRAMS THAT ARE APPROVED BY
THE BOARD UNDER § 5-402 OF THIS SUBTITLE; AND

(5)  ENCOURAGE SCHOOLS OF HIGHER LEARNING TO
ESTABLISH PROGRAMS OF AT LEAST 2 YEARS CREDIT IN THE THEORY
AND PRACTICE OF ELECTROLOGY.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
555B-28.

In the introductory paragraph of this section,
the phrase "in this State" is added to clarify
that the Board has authority only with respect to
electrology education programs that are offered
in this State. This revision gives effect to the
apparent intent behind Ch. 851, Acts of 1978 and
Ch. 715, Acts of 1979. This revision is called
to the attention of the General Assembly.
