Ch. 497

(1)  CONVEY TITLE TO THE ENERGY PROJECT OR
PROJECTS TO THE PERSON, FREE AND CLEAR OF ALL LIENS AND
ENCUMBRANCES, ALL TO THE EXTENT THAT TITLE TO THE ENERGY
PROJECT OR PROJECTS SHALL NOT, AT THE TIME, THEN BE VESTED
IN THE PERSON; AND

(2)  RELEASE SECURITIES HELD AS COLLATERAL BY A
TRUSTEE OR TRUSTEES UNDER THE TRUST AGREEMENT OR RESOLUTION
DETERMINATION TO THE PERSON, WHICH HAD, UNDER THE TRUST
AGREEMENT OR RESOLUTION DETERMINATION, DEPOSITED AND TURNED
OVER THE SECURITIES TO A TRUSTEE OR TRUSTEES IN ORDER TO
ASSURE THE FULL PAYMENT AND RETIREMENT OF THE BONDS, FREE
AND CLEAR OF ALL LIENS AND ENCUMBRANCES, ALL TO THE EXTENT
THAT TITLE TO THE SECURITIES SHALL NOT, AT THE TIME, THEN BE
VESTED IN THE PERSON.

13.120. 535.

(A)  THE AUTHORITY ADMINISTRATION DOES NOT HAVE THE
POWER OF EMINENT DOMAIN.

(B)  NOTHING IN THIS TITLE SUBTITLE MAY BE CONSTRUED TO
ALTER OR RESTRICT THE ZONING OR LAND USE PLANNING AUTHORITY
OF ANY COUNTY, INCORPORATED MUNICIPALITY OR OTHER PUBLIC
INSTRUMENTALITY OF THE STATE.

13-121. 536.

(A)  NOTWITHSTANDING ANY OTHER PROVISION OF THIS TITLE
SUBTITLE THE AUTHORITY ADMINISTRATION SHALL MAKE NO NEW
AWARDS OR COMMITMENTS FOR FINANCIAL ASSISTANCE FOR ENERGY
PROJECTS AFTER JUNE 30, 1991.

(B)  UPON THE DISSOLUTION OF THE AUTHORITY
ADMINISTRATION OR ANY SUCCESSOR TO THE AUTHORITY
ADMINISTRATION, TITLE TO ALL PROPERTY OWNED BY THE AUTHORITY
ADMINISTRATION OR ANY SUCCESSOR TO THE AUTHORITY
ADMINISTRATION SHALL VEST IN THE STATE.

13-122. 537.

(A)  THE PROVISIONS OF THIS TITLE SUBTITLE ARE
SEVERABLE AND IF ANY OF ITS PROVISIONS ARE HELD
UNCONSTITUTIONAL BY ANY COURT OF COMPETENT JURISDICTION, THE
DECISION OF THE COURT SHALL NOT AFFECT OR IMPAIR ANY OF THE
REMAINING PROVISIONS.

(B)  THE PROVISIONS OF THIS TITLE SUBTITLE ARE
SUPPLEMENTAL AND ADDITIONAL TO THE POWERS CONFERRED BY OTHER
LAWS AND THEY ARE NOT IN DEROGATION OF ANY POWER NOW
EXISTING.

SECTION 2. AND BE IT FURTHER ENACTED, That Section(s)
13-101(e) through (o), respectively, of Article - Financial
Institutions, of the Annotated Code of Maryland be
renumbered to be Section(s) 13-101(f) through (p),
respectively.
