examination.

In subsection (f) of this section, the difference
between the prohibition in the present law as to
"the power to grade examinations" or "participate
in activities relating to examinations" is
resolved in favor of the language used in all of
the other health occupations regulated under this
article, and in the latest enactment, Ch. 702,
Acts of 1980. This revision is called to the
attention of the General Assembly.

Present Art. 43, § 555B-16(b), which provides
that the Board shall "administer or approve"
examinations, is deleted as unnecessary in light
of the broad provisions of this section.

5-305. WAIVER OF EXAMINATIONS — OUT-OF-STATE LICENSEES.

(A)  IN GENERAL.

SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD
MAY WAIVE ANY EXAMINATION REQUIREMENT OF THIS TITLE FOR AN
INDIVIDUAL WHO IS LICENSED TO PRACTICE ELECTROLOGY IN ANY
OTHER STATE.

(B)  CONDITIONS.

THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF
THE APPLICANT:

(1)  PAYS THE LICENSE FEE REQUIRED BY § 5-307 OF
THIS SUBTITLE; AND

(2)  PROVIDES ADEQUATE EVIDENCE THAT THE
APPLICANT:

(I)  MEETS THE QUALIFICATIONS OTHERWISE
REQUIRED BY THIS TITLE;

(II)  BECAME LICENSED IN THE OTHER STATE
AFTER PASSING IN THAT OR ANY OTHER STATE AN EXAMINATION THAT
IS SUBSTANTIALLY EQUIVALENT TO THE EXAMINATION FOR WHICH THE
APPLICANT IS SEEKING THE WAIVER; AND

(III)  BECAME LICENSED IN THE OTHER STATE
AFTER MEETING REQUIREMENTS THAT ARE SUBSTANTIALLY EQUIVALENT
TO THE REQUIREMENTS OF THIS TITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
555B-17.

As to subsection (a) of this section, since the
word "licensed" implies "current", "his
qualifying term is deleted as unnecessary.
