[(jj) (1) "Company van pool" means any nonprofit
commuter service provided by or organized by an employee
organization or by a company or a group of companies for its
employees and which:

(i) Transports employees, including the
driver, exclusively between their homes and their employer's
place of business;

(ii) Is available on a nondiscriminatory
basis to all of the employees of the company or group of
companies;

(iii) Does not require participation of
any employee as a condition of employment; and

(iv) Uses motor vehicles having a seating
capacity of no more than 15 persons each as the sole means
of transportation across land.

(2) It does not include any company which
provides commuter service for another company's employees
under a contract or agreement with that company.]

(b) A permit is not required for the following:

DEFINED IN THE TRANSPORTATION ARTICLE;

(E) THIS SUBTITLE DOES NOT APPLY TO ANY VANPOOL,
PROVIDED THE VANPOOL IS REGISTERED AS A VANPOOL VEHICLE IN
COMPLIANCE WITH § 13-934 OF THE TRANSPORTATION ARTICLE AND
DISPLAYS APPROPRIATE REGISTRATION PLATES ISSUED BY THE MOTOR
VEHICLE ADMINISTRATION.

(b) The term "commercial motor vehicle" means a
passenger vehicle that has seats for more than [nine] 14
passengers in addition to the driver [,]AND FOR THE
OPERATION OF WHICH A PERMIT IS REQUIRED BY THE PUBLIC
SERVICE COMMISSION, or any road tractor, or any
truck-tractor or any truck having more than two axles; which
commercial motor vehicle is propelled by motor fuel.
