Ch.8

State's attorney to prosecute violations of Art. 32, is
deleted as unnecessary in light of Art. 10, § 34 of the
Code, which provides generally for the statutory duties of
the State's attorney. The second sentence of this section,
which relates to the counsel to the Department being the
legal adviser to the Board, is unnecessary in light of Art.
41, § 206(d) of the Code.

Present Art. 32, § 23, which provides for the
severability of the provisions of this title, is deleted as
unnecessary in light of Art. 1, § 23 of the Code.

Present Art. 32, § 24, which provides for prosecutions
under Ch. 564, Acts of 1933, is deleted as obsolete and, in
any event, unnecessary in light of Art. 1, § 3 of the Code.

Present Art. 32, § 34, which provides for liberal
construction and severability of the provisions of the
subtitle of present Art. 32 that deal with dental
hygienists, is deleted as unnecessary in light of Art. 1, §
23 of the Code and other independent provisions of law.

TITLE 5. ELECTROLOGISTS.

SUBTITLE 1. DEFINITIONS; GENERAL PROVISIONS.

5-101. DEFINITIONS.

(A)  IN GENERAL.

IN THIS TITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(B)  BOARD.

"BOARD" MEANS THE STATE BOARD OF ELECTROLOGISTS.

(C)  ELECTROLOGIST.

"ELECTROLOGIST" MEANS AN INDIVIDUAL WHO PRACTICES
ELECTROLOGY.

(D)  ELECTROLOGY INSTRUCTOR.

"ELECTROLOGY INSTRUCTOR" MEANS AN INDIVIDUAL WHO
PRACTICES ELECTROLOGY AND TEACHES THE CLINICAL PRACTICE OF
ELECTROLOGY.

(E)  LICENSE.

"LICENSE" MEANS, UNLESS THE CONTEXT REQUIRES OTHERWISE,
A LICENSE ISSUED BY THE BOARD:

(1)  TO PRACTICE ELECTROLOGY; OR

(2)  TO PRACTICE ELECTROLOGY AND TEACH THE
CLINICAL PRACTICE OF ELECTROLOGY.
