Ch. 436

A DEALER MAY NOT PURCHASE OR ACQUIRE PRECIOUS METALS
FROM AN INDIVIDUAL UNDER 18 YEARS OLD.

425.

(A)  THE SECRETARY HAS THE POWER AND AUTHORITY TO ADOPT
AND ENFORCE RULES AND REGULATIONS WHICH ARE CONSISTENT WITH
AND IN FURTHERANCE OF THE PROVISIONS OF THIS SUBTITLE.

(B)  A COUNTY OR MUNICIPAL CORPORATION MAY NOT ENACT
ANY LOCAL LEGISLATION LAW, ORDINANCE, OR REGULATION
REGULATING SECONDHAND PRECIOUS METALS AND GEM DEALERS, AND
THIS SUBTITLE SUPERCEDES AND PREEMPTS ALL SUCH EXISTING
LAWS, ORDINANCES, OR REGULATIONS.

(C)  A COUNTY OR MUNICIPAL CORPORATION MAY ENACT A
LOCAL LAW, ORDINANCE, OR REGULATION REGULATING NUMISMATIC
ITEMS UNTIL JUNE 1, 1983, AFTER WHICH TIME ANY SUCH EXISTING
LAW, ORDINANCE, OR REGULATION IS NULL AND VOID. THIS
SUBTITLE SUPERSEDES AND PREEMPTS THE REGULATION OF
NUMISMATIC ITEMS BY A COUNTY OR MUNICIPAL CORPORATION AFTER
JUNE 1, 1983.

426.

(A)  A PERSON WHO WILLFULLY OR KNOWINGLY VIOLATES ANY
PROVISION OF THIS SUBTITLE AND EACH ASSOCIATE, PARTNER,
MANAGER, OR EMPLOYEE WHO PARTICIPATES IN A VIOLATION OR
CONSENTS TO A VIOLATION, IS GUILTY OF A MISDEMEANOR AND ON
CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $5,000 OR
IMPRISONMENT NOT EXCEEDING 1 YEAR, OR BOTH.

(B)  EACH SEPARATE VIOLATION OF THIS SUBTITLE
CONSTITUTES A SEPARATE OFFENSE, AS DOES EACH SEPARATE
VIOLATION OF ANY PROVISION OF THIS SUBTITLE.

427.

ANY PERSON WHOSE LICENSE OR RENEWAL APPLICATION IS
DENIED OR WHOSE LICENSE IS SUSPENDED OR REMOVED REVOKED MAY
APPEAL AS PROVIDED IN THE ADMINISTRATIVE PROCEDURE ACT. THE
DENIAL, NONRENEWAL, SUSPENSION, OR REVOCATION OF A LICENCE
SHALL BE PRECEDED BY NOTICE AND AN OPPORTUNITY TO BE HEARD
AS PROVIDED IN THE ADMINISTRATIVE PROCEDURE ACT, AND AN
APPLICANT OR LICENSEE IS ENTITLED TO JUDICIAL REVIEW AS
PROVIDED IN THAT ACT.

SECTION 2. AND BE IT FURTHER ENACTED, That the
provisions of this Act are expressly made severable, and
that notwithstanding Article 1, § 23, the invalidity of any
one or more sections, subsections, paragraphs, or
requirements of this Act, or the application thereof, shall
not affect the validity of the remaining portions of this
Act.
