(3) HAS BEEN CONVICTED OF A FELONY, THEFT
OFFENSE, OR A CRIME INVOLVING MORAL TURPITUDE WITHIN THE 3
YEARS IMMEDIATELY PRECEDING THE DATE OF THE APPLICATION OR
AT ANY TIME AFTER THE DATE OF THE APPLICATION; OR
(4) HAS WILLFULLY MISREPRESENTED OR HAS
WILLFULLY FAILED TO FURNISH ANY INFORMATION REQUIRED TO BE
FURNISHED UNDER THIS SUBTITLE.
420.
(A) EACH LICENSE ISSUED UNDER THIS SUBTITLE SHALL
EXPIRE ON APRIL 30 OF EACH YEAR UNLESS RENEWED BY FILING AN
APPLICATION FOR RENEWAL WITH THE SECRETARY AND PAYING A
RENEWAL FEE OF $100.
(B) EACH APPLICATION FOR RENEWAL SHALL BE SIGNED AND
VERIFIED UNDER OATH AND SHALL STATE THAT:
(1) ALL INFORMATION IN THE ORIGINAL APPLICATION
AS UPDATED IS CURRENT;
(2) THE DEALER AGREES TO COMPLY WITH ALL THE
REQUIREMENTS APPLICABLE TO THE ORIGINAL APPLICATION; AND
(3) THAT THE DEALER HAS NOT VIOLATED ANY
PROVISION OF THIS SUBTITLE, BEEN CONVICTED OF ANY OFFENSE
ENUMERATED IN § 419(C), OR HAD A SIMILAR LICENSE REFUSED,
SUSPENDED, OR REVOKED IN ANOTHER JURISDICTION.
(C) THE SECRETARY OF LICENSING AND REGULATION MAY
REFUSE TO RENEW THE LICENSE OF ANY DEALER WHO IS UNABLE TO
COMPLY WITH SUBSECTION (B) OF THIS SECTION.
(D) THE SECRETARY SHALL INFORM THE APPROPRIATE LOCAL
LAW ENFORCEMENT AGENCY COUNTY POLICE DEPARTMENT, OR IF NONE,
THE SHERIFF'S DEPARTMENT AGENCY EXERCISING PRIMARY LAW
ENFORCEMENT AUTHORITY AGENCY FOR THE COUNTY OF EACH LICENSE
ISSUED, RENEWED, REFUSED, REVOKED, OR SUSPENDED.
421.
(A) THE SECRETARY OF LICENSING AND REGULATION MAY NOT
ISSUE A LICENSE UNDER THIS SUBTITLE FOR A BUSINESS ADDRESS
WHICH IS A HOTEL OR MOTEL ROOM, OR A MOTOR VEHICLE OR A POST
OFFICE BOX. A LICENSE MAY BE ISSUED ONLY FOR A FIXED
ADDRESS.
(B) A DEALER SHALL PROMINENTLY DISPLAY A LICENSE AT
THE ADDRESS FOR WHICH THE LICENSE IS ISSUED, AND MAY NOT DO
BUSINESS AT ANY OTHER LOCATION, EXCEPT THAT A DEALER MAY :
OPERATE FOR UP TO 7 CONSECUTIVE DAYS AT A BONAFIDE AUCTION,
SHOW, OR EXHIBITION, OR ESTATE SALE WITH THE WRITTEN
APPROVAL OF THE LOCAL LAW ENFORCEMENT AGENCY HAVING
JURISDICTION OVER THE PLACE WHERE THE AUCTION, SHOW, OR
EXHIBITION, OR ESTATE SALE WILL BE HELD.
