AN ACT concerning

Probation - Period Longer Than Sentence

FOR the purpose of allowing a court to grant probation for a
period, in excess of 5 years with the written consent
of the defendant for purposes of making restitution;
and clarifying language.

BY repealing and reenacting, with amendments,

Article 27 - Crimes and Punishments

Section 641A(a)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

641A.

(A) Upon entering a [judgment of conviction, the court
having jurisdiction[,] may suspend the imposition or
execution of sentence and place the defendant on probation
upon such terms and conditions as the [courts deem] COURT
DEEMS proper. The court may impose a sentence for a
specified period and provide that a lesser period be served
in confinement, suspend the remainder of the sentence and
grant probation for a period longer than the sentence but
not in excess of five years, HOWEVER, IF THE DEFENDANT
CONSENTS IN WRITING, THE COURT MAY GRANT PROBATION IN EXCESS
OF 5 YEARS, BUT ONLY FOR PURPOSES OF MAKING RESTITUTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
