SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Courts and Judicial Proceedings

SUBTITLE 4. MARYLAND TORT CLAIMS ACT

5-401.

(A)  IN THIS SUBTITLE, UNLESS THE CONTEXT CLEARLY
REQUIRES OTHERWISE, THE FOLLOWING WORDS HAVE THE MEANING
INDICATED.

(B)  "MOTOR VEHICLE" MEANS ANY VEHICLE WHICH IS
SELF-PROPELLED, INCLUDING VEHICLES OPERATED BY RAIL, THROUGH
WATER, OR IN THE AIR, AND ANY ATTACHMENT THERETO.

(C)  "STATE" MEANS THE STATE OF MARYLAND AND ANY
DEPARTMENT OR AGENCY OF THE STATE OF MARYLAND, BUT DOES NOT
INCLUDE ANY COUNTY, MUNICIPALITY, BI-COUNTY AGENCY, OR OTHER
POLITICAL SUBDIVISION OF THE STATE OR ANY DEPARTMENT
DEPARTMENT, AGENCY, OR UNIT OF ANY COUNTY, MUNICIPALITY,
BI-COUNTY AGENCY, OR OTHER SUBDIVISION.

(D)  "STATE EMPLOYEE" MEANS:

(1)  ANY CLASSIFIED, UNCLASSIFIED, CONTRACTUAL,
OR KEY EMPLOYEE OF THE STATE FOR WHOM COMPENSATION IS PAID,
IN WHOLE OR IN PART, FROM STATE FUNDS;

(2)  ANY PERSON WHO IS PROVIDING A SERVICE TO OR
ON BEHALF OF THE STATE AS A VOLUNTEER; AND

(3)  ANY PERSON WHO EXERCISES A PORTION OF THE
SOVEREIGNTY OF THE STATE, WHETHER WITH OR WITHOUT
COMPENSATION.

(E)  "STATE PROPERTY" MEANS ANY TANGIBLE PROPERTY,
REAL, PERSONAL, OR MIXED, WHICH IS OWNED OR IN THE
POSSESSION OF THE STATE.
