1556                                   LAWS OF MARYLAND                                 Ch. 270

(2) THE HEALTH OFFICER FOR A COUNTY SHALL
ENFORCE IN EACH MUNICIPALITY OR SPECIAL TAXING DISTRICT IN
THE COUNTY A RULE OR REGULATION THAT THE COUNTY BOARD OF
HEALTH ADOPTS UNLESS THE MUNICIPALITY OR DISTRICT ENACTS A
CHARTER PROVISION OR ORDINANCE THAT:

(I)  COVERS THE SAME SUBJECT MATTER AS THE
RULE OR REGULATION;

(II)  IS AT LEAST AS RESTRICTIVE AS THE
RULE OR REGULATION; AND

(III)  INCLUDES PROVISIONS FOR ENFORCEMENT
OF THE ENACTMENT.

(E)  IF A HEALTH EMERGENCY EXISTS, THE SECRETARY
TEMPORARILY MAY ASSIGN A HEALTH OFFICER TO ANOTHER COUNTY OR
BALTIMORE CITY.

(F)  AS COUNTY REGISTRAR OF VITAL RECORDS, EACH HEALTH
OFFICER SHALL PROMOTE EFFICIENT REGISTRATION OF BIRTHS AND
DEATHS IN THE COUNTY.

(G)  A HEALTH OFFICER MAY OBTAIN SAMPLES OF FOOD AND
DRUGS FOR ANALYSIS.

(H) A HEALTH OFFICER SHALL INSPECT AND REPORT ON THE
SANITARY CONDITIONS OF STREAMS AND SOURCES OF PUBLIC WATER
SUPPLY, SEWERAGE FACILITIES, SCHOOLS, AND PLACES OF BUSINESS
OR EMPLOYMENT IN THE COUNTY.

(I) A HEALTH OFFICER SHALL PERFORM ANY INVESTIGATION
OR OTHER DUTY OR FUNCTION DIRECTED BY THE SECRETARY OR THE
COUNTY BOARD OF HEALTH AND SUBMIT APPROPRIATE REPORTS TO
THEM.

(J) IN THE PERFORMANCE OF OFFICIAL DUTIES, A HEALTH
OFFICER MAY ENTER ANY PRIVATE HOUSE OR ANY PLACE OF BUSINESS
OR EMPLOYMENT WHERE:

(1)  CONSENT TO ENTER AND INSPECT HAS BEEN
OBTAINED;

(2)  A WARRANT HAS BEEN OBTAINED; OR

(3)  AN EXCEPTIONAL OR EMERGENCY SITUATION EXISTS
WHERE TIME OR OPPORTUNITY TO OBTAIN A WARRANT IS LACKING.

(K) IN THE PERFORMANCE OF OFFICIAL DUTIES, A HEALTH
OFFICER MAY ENTER ANY PLACE OF BUSINESS OR EMPLOYMENT.

Whenever any [local or county] health officer shall
receive reliable notice, or shall otherwise have reason to
believe that there is within the [limits of his sanitary
jurisdiction] COUNTY a case of cholera, smallpox or other
