Ch. 270

(IV) (III) (3) SUBJECT TO PARAGRAPH (2) OF

THIS SUBSECTION, BE A PHYSICIAN LICENSED TO PRACTICE

MEDICINE BY A STATE.

(2) AN INDIVIDUAL WHO IS NOT LICENSED TO

PRACTICE MEDICINE IN THIS STATE, BUT IS LICENSED TO PRACTICE
MEDICINE IN ANOTHER STATE AND MEETS THE OTHER QUALIFICATIONS
UNDER PARAGRAPH (1) OF THIS SUBSECTION MAY BE APPOINTED
HEALTH OFFICER. HOWEVER, IF THE INDIVIDUAL FAILS TO BECOME
LICENSED TO PRACTICE IN THIS STATE WITHIN 1 YEAR AFTER
APPOINTMENT, THE INDIVIDUAL CEASES TO BE A HEALTH OFFICER.

(3) THE HEALTH OFFICER FOR PRINCE GEORGE'S

COUNTY:

(I) NEED NOT BE A PHYSICIAN; BUT

(II) SHALL MEET ALL OTHER QUALIFICATIONS
REQUIRED IN PARAGRAPH (1) OF THIS SUBSECTION NEED NOT BE A
PHYSICIAN, WHERE THERE IS A DEPUTY HEALTH OFFICER WHO IS A
PHYSICIAN AND WHO MEETS THE QUALIFICATIONS LISTED UNDER
SECTION 51A(C).

(D)  UPON TAKING OFFICE, EACH APPOINTEE TO THE OFFICE
OF HEALTH OFFICER SHALL TAKE THE OATH REQUIRED BY ARTICLE I,
§ 9 OF THE STATE CONSTITUTION.

(E)  EACH HEALTH OFFICER IS AN UNCLASSIFIED STATE
EMPLOYEE.

(F)  THE HEALTH OFFICER FOR A COUNTY IS ENTITLED TO:

(1)  THE SALARY PROVIDED IN THE STATE BUDGET;

(2)  ANY ADDITIONAL SALARY THAT THE COUNTY
PROVIDES; AND

(3)  REIMBURSEMENT FOR EXPENSES UNDER THE
STANDARD STATE TRAVEL REGULATIONS, AS PROVIDED IN THE STATE
BUDGET.

(C) THE HEALTH OFFICER FOR A COUNTY SERVES AT THE
PLEASURE OF THE GOVERNING BODY OF THAT COUNTY, BUT MAY NOT
BE REMOVED WITHOUT THE CONCURRENCE OF THE SECRETARY.

(G)  THE HEALTH OFFICER FOR A COUNTY SERVES AT THE
PLEASURE OF THE GOVERNING BODY OF THAT COUNTY AND THE
SECRETARY. THE HEALTH OFFICER FOR A COUNTY MAY BE REMOVED
FROM OFFICE WITH THE CONCURRENCE OF THE GOVERNING BODY OF
THAT COUNTY AND THE SECRETARY.

(H) THIS SECTION DOES NOT PREVENT AN INDIVIDUAL FROM
SERVING AS HEALTH OFFICER FOR MORE THAN ONE COUNTY.
