1548                                    LAWS OF MARYLAND                                 Ch. 270

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 23B - Municipal Corporation Charter

22.

(30) To protect and preserve the health of the town
and its inhabitants; [to appoint a public health officer,
and to define and regulate his powers and duties;] to
prevent the introduction of contagious diseases into the
town; to establish quarantine regulations, and to authorize
the removal and confinement of persons having contagious or
infectious diseases; to prevent and remove all nuisances; to
inspect, regulate, and abate any buildings, structures, or
places which cause or may cause unsanitary conditions or
conditions detrimental to health; but nothing herein shall
be construed to affect in any manner any of the powers and
duties of the [State Board of Health] SECRETARY OF HEALTH
AND MENTAL HYGIENE, the county board of health, or any
public general or local law relating to the subject of
health.

Article 43 - Health

[6.

The Commissioner of Health of Maryland shall divide the
State outside of Baltimore City into twenty-three sanitary
districts following county lines, and, with the approval of
the Secretary of Health and Mental Hygiene, he shall appoint
a deputy State health officer for each sanitary district.]

The deputy State health officers shall be experienced
physicians having qualifications in the field of public
health determined by the Secretary of Health and Mental
Hygiene. In Prince George's County the deputy State health
officer shall be a person whose qualifications in public
health shall be determined by the Secretary of the
Department of Health and Mental Hygiene except that the
requirement that this person be a physician need not apply.
The deputy State health officers shall hold their office
during efficiency and good behavior, but may be removed, in
the manner provided in § 33 of Article 64A, title "Merit
System." No deputy State health officer shall practice
medicine or engage in any occupation which would conflict
with the performance of his official duties. Each deputy
State health officer shall have an office located at some
accessible point designated by the Secretary of Health and
Mental Hygiene, within his sanitary district. He shall
receive a salary as provided in the State budget and
whatever expenses he actually and necessarily incurred in
the performance of his official duties.]
