present Art. 32, § 5A(d) — which now appears in
§ 4-503 of this title — which refers to
establishing "fees ... for licensed dentists
seeking Board identification as a specialist",
and Art. 32, § 6A(b)(l) — which now appears in §
4-310 of this title — which refers to "a
reasonable license or annual renewal fee set by
the Board".

As to subsection (b) of this section, the second
sentence of present Art. 32, § 9, which requires
that disbursement of funds be in accordance with
Art. III, §§32 and 52 of the State Constitution
or Art. 15A, §§ 1 through 15 of the Code, which
relate to disbursements from the General Fund of
this State, is deleted as implicit in the
requirement that the funds are part of the
General Fund of this State.

4-208. SUITS BY AND AGAINST BOARD.

THE BOARD MAY SUE AND BE SUED IN ITS OWN NAME IN THE
COURTS OF THIS STATE.

without substantive change from Art. 32, § 20.

SUBTITLE 3. LICENSING.

4-301. LICENSE REQUIRED; EXCEPTIONS.

(A)  IN GENERAL.

(1)  EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE,
AN INDIVIDUAL SHALL BE LICENSED BY THE BOARD TO PRACTICE
DENTISTRY BEFORE THE INDIVIDUAL MAY PRACTICE DENTISTRY ON A
HUMAN BEING IN THIS STATE.

(2)  EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE,
AN INDIVIDUAL SHALL BE LICENSED BY THE BOARD TO PRACTICE
DENTAL HYGIENE BEFORE THE INDIVIDUAL MAY PRACTICE DENTAL
HYGIENE ON A HUMAN BEING IN THIS STATE.

(B)  EXCEPTIONS.

THIS SECTION DOES NOT APPLY TO:

(1)  A STUDENT OF DENTISTRY WHILE ENGAGED IN AN
EDUCATIONAL PROGRAM AT AN APPROVED SCHOOL OF DENTISTRY;

(2)  A DENTIST WHILE PERFORMING OFFICIAL DUTIES
IN A FEDERAL DENTAL SERVICE;

(3)  AN INDIVIDUAL LICENSED TO PRACTICE DENTISTRY
IN ANY OTHER STATE OR A FOREIGN COUNTRY, WHILE THE
INDIVIDUAL:
