AN ACT concerning

Motor Vehicles - Offense Records

FOR the purpose of requiring the Motor Vehicle
Administration to keep records of probation before
judgment dispositions in certain cases; restricting the
use of these records; providing that certain personnel
may not disclose certain information under certain
circumstances; and prohibiting insurers under
automobile insurance policies from considering such
records for purposes of reclassifying insureds in a
classification entailing a higher premium.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article - Transportation

16-117.

(b) (1) The Administration shall file each accident
report and abstract of court [conviction] DISPOSITION
records that it receives under the laws of this State.

(2) The Administration shall keep convenient
records or make suitable notations showing the convictions
or traffic accidents in which each licensee has been
involved AND EVERY PROBATION BEFORE JUDGMENT DISPOSITION OF
ANY MOTOR VEHICLE LAW OFFENSE PUNISHABLE BY IMPRISONMENT
VIOLATION OF § 21-902 OF THIS ARTICLE. A RECORD OR NOTATION
