vehicle while intoxicated or while under the influence of a
controlled dangerous substance; or

(2) Within a 3-year period, is convicted under §
21-902(b) or (c) of this article of three or more violations
of driving or attempting to drive a motor vehicle while [his
driving ability is impaired by] UNDER THE INFLUENCE OF
alcohol or while under the influence of drugs or drugs and
alcohol.

(b)  The Administration may suspend for not more than
60 days the license of any individual who is convicted under
§ 21-902(b) or (c) of this article of driving or attempting
to drive a motor vehicle while [his driving ability is
impaired by] UNDER THE INFLUENCE OF alcohol or while under
the influence of drugs or drugs and alcohol.

(c)  The Administration may suspend for not more than
120 days the license of any individual who, within a 3-year
period, is convicted under § 21-902(b) or (c) of this
article of two violations of driving or attempting to drive
a motor vehicle while [his driving ability is impaired by]
UNDER THE INFLUENCE OF alcohol or while under the influence
of drugs or drugs and alcohol.

(d)  When a suspension imposed under subsections (b)
and (c) of this section expires, the Administration
immediately shall return the license or reinstate the
privilege of the driver, unless the license or privilege has
been refused, revoked, suspended, or canceled under any
other provisions of the Maryland Vehicle Law.

16-402.

(a) After the conviction of an individual for a
violation of the vehicle laws or regulations of this State
or of any local authority, points shall be assessed against
the individual as follows:

(1)  Any moving violation not listed below and
not contributing to an accident......................1 point

(2)  Speeding in excess of the posted speed limit
by 10 miles an hour or more.........................2 points

(3)  Driving with an improper class of

license.............................................2 points

(4)  Failing to stop for a school vehicle with
alternately flashing lights.........................2 points

(5)  Any moving violation contributing to an
accident............................................3 points

(6)  Reckless driving....................4 points
