(B) SEPARATE OFFENSE FOR EACH DAY.
EACH DAY THAT A VIOLATION OCCURS IS PERSON PRACTICES
WELL DRILLING WITHOUT A LICENSE CONSTITUTES A SEPARATE
OFFENSE.
REVISOR'S NOTE: Subsection (a) of this section is new
language patterned after NR § 8-1501.
Subsection (b) of this section is new language
derived without substantive change from the
second sentence of NR § 8-613.
Subsection (a)(2) of this section is revised to
clarify that a subsequent offense relates to any
violation of this title. The General Assembly
may wish to consider whether a "second or
subsequent offense" should be revised more
narrowly to read "any subsequent violation of the
same provision". The reference to fines and
costs in NR § 8-1501 is not added to this section
since the reference is superfluous.
The attention of the General Assembly is called
to use of the defined term "person" in this
section. See § 21-101(d) of this title and its
revisor's note for a discussion of the scope of
the term "person" in this title.
SUBTITLE 6. SHORT TITLE; TERMINATION OF TITLE.
21-601. SHORT TITLE.
THIS TITLE MAY BE CITED AS THE "MARYLAND WELL DRILLERS
ACT" .
REVISOR'S NOTE: This section is new language added to
conform to similar sections in other titles of
this article and to provide a convenient
reference to this title.
21-602. TERMINATION OF TITLE.
SUBJECT TO THE REGULATORY PROGRAMS EVALUATION ACT OF
1978, THE PROVISIONS OF THIS TITLE AND ALL RULES AND
REGULATIONS ADOPTED UNDER THIS TITLE CREATING THE STATE
BOARD OF WELL DRILLERS AND RELATING TO THE REGULATION OF
WELL DRILLERS ARE OF NO EFFECT AND MAY NOT BE ENFORCED AFTER
JULY 1, 1987.
