to terminate a temporary license at any time.
This is to clarify that the Board sets the
expiration date when it issues the temporary
license.

As to bond and insurance requirements of the
Board see § 21-206 of this title.

As to examinations see § 21-304 of this subtitle.

21-310. DENIALS, REPRIMANDS, SUSPENSIONS, AND REVOCATIONS.

(A) MANDATORY ACTION.

SUBJECT TO THE HEARING PROVISIONS OF § 21-311 OF THIS
SUBTITLE, THE BOARD SHALL SUSPEND OR REVOKE A LICENSE IF THE
LICENSEE:

(1) FRAUDULENTLY OR DECEPTIVELY OBTAINS OR
ATTEMPTS TO OBTAIN A LICENSE FOR THE LICENSEE OR FOR
ANOTHER;

OR

(2) FRAUDULENTLY OR DECEPTIVELY USES A LICENSE;

(3) IS GUILTY OF GROSS NEGLIGENCE, INCOMPETENCE,
OR MISCONDUCT WHILE PRACTICING WELL DRILLING.

(B)  DENIAL.

SUBJECT TO THE HEARING PROVISIONS OF § 21-311 OF THIS
SUBTITLE, THE BOARD MAY DENY A LICENSE TO ANY APPLICANT ON
ANY OF THE GROUNDS SPECIFIED IN SUBSECTION (A) OF THIS
SECTION.

(C)  DISCRETIONARY ACTION.

SUBJECT TO THE HEARING PROVISIONS OF § 21-311 OF THIS
SUBTITLE, THE BOARD MAY DENY A LICENSE TO ANY APPLICANT,
REPRIMAND A LICENSEE, OR SUSPEND OR REVOKE A LICENSE IF THE
BOARD FINDS THAT THE APPLICANT OR LICENSEE HAS VIOLATED ANY
LAW, RULE, OR REGULATION THAT APPLIES TO PRACTICING WELL
DRILLING.

REVISOR'S NOTE: This section is new language derived
without substantive change from NR § 8-611(a).

In subsection (a) of this section, the phrase
"attempts to obtain" and the term "uses" are
added to provide expressly fundamental grounds
for disciplining a licensee and to conform to
similar provisions governing other health
occupations.

In subsections (b) and (c) of this section, the
reference to license denial is standard language
added to this, and, where necessary,
