21-301. LICENSING REQUIRED.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, A PERSON
SHALL BE LICENSED BY THE BOARD BEFORE THE PERSON MAY
PRACTICE WELL DRILLING IN THIS STATE.

21-302. QUALIFICATIONS OF APPLICANTS.

(A)  IN GENERAL.

THE BOARD SHALL ADOPT RULES AND REGULATIONS FOR THE
QUALIFICATIONS OF APPLICANTS.

(B)  REQUIREMENTS.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, TO QUALIFY
FOR A LICENSE, AN APPLICANT SHALL MEET ANY REASONABLE
QUALIFICATIONS OR REQUIREMENTS THAT THE BOARD ESTABLISHES
FOR LICENSE APPLICANTS.

REVISOR'S NOTE: This section is new language derived
without substantive change from the general
rulemaking authority of the Board in the second
sentence of NR § 8-607(d), and the second
sentence and the first clause of the third
sentence of NR § 8-610(a).

In subsection (b) of this section, the reference
to meeting "any reasonable qualifications or
requirements that the Board establishes" is
substituted for the reference to "Part III
dealing with well drillers", for clarity.

As to the Board's requirement of a performance
bond and contractor's liability insurance see §
21-206 of this title.

As to examinations that may be required of
applicants see § 21-304 of this subtitle.

As to qualifications of an applicant for a
temporary license see § 21-309 of this subtitle.

21-303. APPLICATIONS FOR LICENSES.

TO APPLY FOR A LICENSE, AN APPLICANT SHALL:

(1) SUBMIT AN APPLICATION TO THE BOARD ON THE
FORM THAT THE BOARD REQUIRES; AND
