Ch. 237

1.  ONE FROM CAROLINE, CECIL,
DORCHESTER, KENT, QUEEN ANNE'S, SOMERSET, TALBOT, WICOMICO,
OR WORCESTER COUNTY;

2.  ONE FROM BALTIMORE CITY OR
BALTIMORE, CARROLL, HARFORD, HOWARD, OR MONTGOMERY COUNTY;

3.  ONE FROM ANNE ARUNDEL, CALVERT,
CHARLES, PRINCE GEORGE'S, OR ST. MARY'S COUNTY; AND

4.  ONE FROM ALLEGANY, FREDERICK,
GARRETT, OR WASHINGTON COUNTY.

(B)  OATH.

BEFORE TAKING OFFICE, EACH APPOINTEE TO THE BOARD SHALL
TAKE THE OATH REQUIRED BY ARTICLE I, § 9 OF THE STATE
CONSTITUTION.

(C)  TENURE; VACANCIES.

(1)  THE TERM OF A MEMBER IS 2 YEARS.

(2)  AT THE END OF A TERM, A MEMBER CONTINUES TO
SERVE UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(3)  A MEMBER WHO IS APPOINTED AFTER A TERM HAS
BEGUN SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.

(D)  REMOVAL.

THE GOVERNOR MAY REMOVE A MEMBER FOR INCOMPETENCE OR
MISCONDUCT.

REVISOR'S NOTE: This section is new language derived
without substantive change from NR § 8-607(b) —
except for the reference in that subsection to
the Board chairman.

In subsection (a)(2) of this section, the phrase
"licensed master well drillers" is substituted
for the phrase "licensed well driller" to express
the apparent legislative intent and to conform to
current practice. When the Board was established
by Ch. 584, Acts of 1968, there was only one
license category — that which is now a master
well driller license; Ch. 299, Acts of 1970,
provided for additional license categories, but
did not amend this provision.

As to subsection (a)(2)(iii) of this section, the
attention of the General Assembly is called to
the fact that Ch. 702, Acts of 1980, established
a uniform system for consumer representatives for
other health occupation regulating boards but did
not include this Board or the State Board of
Waterworks and Waste Systems Operators.
