Present Art. 43, § 406A(b)(6)(ii), which
authorizes certain tasks for a certified
operator, now appears in § 20-306 of this title.

(J) RESPONSIBLE CHARGE.

"RESPONSIBLE CHARGE" MEANS RESPONSIBILITY FOR THE
OPERATION AND PERFORMANCE OF ALL OR ANY PART OF A
WATERWORKS, WASTEWATER WORKS, OR INDUSTRIAL WASTEWATER
WORKS.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from Art. 43, §
406A(b)(4).

The present phrase "day-by-day" is deleted as
unnecessary.

(K) SUPERINTENDENT.

"SUPERINTENDENT" MEANS AN INDIVIDUAL WHO IS DESIGNATED
BY ANY EMPLOYING OR APPOINTING PERSON, COUNTY, MUNICIPALITY,
SANITARY DISTRICT, OR THIS STATE AS THE INDIVIDUAL IN
RESPONSIBLE CHARGE OF A WATERWORKS, WASTEWATER WORKS, OR
INDUSTRIAL WASTEWATER WORKS.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the first
sentence of Art. 43, § 406A(b)(5).

The present terms "corporation", "company", and
"institution" are deleted as unnecessary in light
of the defined term "person".

The second sentence of present Art. 43, §
406A(b)(5), which states what the term
"superintendent" encompasses, is deleted as
unnecessary.

As to the supervision of a waterworks, wastewater
works, or industrial wastewater works by a
superintendent, see § 20-402 of this title.

(L) WASTEWATER WORKS.

(1)  "WASTEWATER WORKS" MEANS A FACILITY USED TO
COLLECT, STORE, PUMP, TREAT, OR DISCHARGE ANY LIQUID OR
WATERBORNE WASTE.

(2)  "WASTEWATER WORKS" DOES NOT INCLUDE:

(I) A FACILITY THAT IS USED ONLY BY A
PRIVATE RESIDENCE;

(II) A FACILITY THAT USES A SEPTIC TANK OR
SUBSOIL ABSORPTION; OR
