[A] UNLESS A person [who] is [not] a licensed
mortician, A LICENSED FUNERAL DIRECTOR, OR A HOLDER OF A
SURVIVING SPOUSE LICENSE, THE PERSON may not offer or agree,
directly or indirectly, to provide services or merchandise
under a pre-need contract.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.

AN ACT concerning

Funeral Establishments - Operators

FOR the purpose of allowing funeral establishments to be
operated by a licensed funeral director.

BY repealing and reenacting, with amendments,

Article - Health Occupations
Section 6-310(c)
Annotated Code of Maryland

(As enacted by Chapter ____ (H.B. 1) of the Acts

of the General Assembly of 1981)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter ___ (H.B.I) of the Acts of the

General Assembly of 1981) be repealed, amended, or enacted
to read as follows:

Article - Health Occupations

6-310.

(c) The Board shall issue a funeral establishment
license to a funeral establishment that:

(1)  Has complied with all applicable State and
local laws; and

(2)  Will be operated in accordance with this
title by at least one licensed mortician OR ONE LICENSED
FUNERAL DIRECTOR.
