(2)  The Division shall keep records of any
payments or return of property in satisfaction of the order.

(3)  The Division shall forward any property or
payments to the victim of the crime, EXCEPT THAT, IF THE
PAYMENTS ARE MADE FOR MEDICAL EXPENSES THAT WERE PAID BY THE
DEPARTMENT OF HEALTH AND MENTAL HYGIENE OR ANOTHER
GOVERNMENTAL ENTITY, THE PAYMENTS SHALL BE FORWARDED TO THE
DEPARTMENT OR GOVERNMENTAL ENTITY.

(4)  The Division may assess additional fees not
to exceed 2 percent of the amount of the order to pay for
administrative costs of collecting payments or property.
These fees shall be paid by the defendant.

(e)  When a defendant fails to make restitution as
ordered, the Division shall notify the court. The court may
hold a hearing to determine if the defendant is in contempt
of court or has violated the terms of the probation or
parole.

(f)  An order of restitution may not preclude the owner
of the property or the victim who suffered personal physical
or mental injury or out of pocket loss of earnings or
support from proceeding in a civil action to recover damages
from the defendant. A civil verdict shall be reduced by the
amount paid under the criminal restitution order.

SECTION 2. AND BE IT FURTHER ENACTED", That this Act
shall take effect July 1, 1981.

(House Bill 441)

AN ACT concerning

Admissions and Amusement Tax - Bonds

FOR the purpose of enabling the Comptroller, or his agent,
to require certain bonds to secure payment of certain
admissions and amusement taxes and penalties under
certain circumstances; authorizing deposit of certain
security, an irrevocable letter of credit, or cash in
lieu of bonds; providing for notice of the bond
requirement and for certain hearings and determinations
on the bonds; requiring compliance with the
determination within a certain time; and renumbering
certain provisions.
