AN ACT concerning

Boards of Chiropractors, Electrology, and Pharmacy -
Disciplinary Action

FOR the purpose of allowing the Boards of Chiropractors,
Electrology, and Pharmacy to impose a certain penalty
in lieu of or in addition to suspension or in addition
to revocation of a license; requiring that any
penalties collected be paid to the General Fund of the
State; and requiring the Boards to adopt rules and
regulations to set standards for such penalties.

Sections 3-310.1, 5-311.1, 12-311.1, and 12-409.1

Annotated Code of Maryland

(As enacted by Chapter ____(H.B. 1) of the Acts of the

General Assembly of 1981)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter ____ (H.B. 1) of the Acts of the

General Assembly of 1981) be repealed, amended, or enacted
to read as follows:

Article - Health Occupations

3-310.1.

(A)  IF AFTER A HEARING UNDER § 3-311 OF THIS SUBTITLE
THE BOARD FINDS THAT THERE ARE GROUNDS UNDER § 3-310 OF THIS
SUBTITLE TO SUSPEND OR REVOKE A LICENSE, THE BOARD MAY
IMPOSE A PENALTY NOT EXCEEDING $5,000:

(1)  INSTEAD OF SUSPENDING THE LICENSE; OR

(2)  IN ADDITION TO SUSPENDING OR REVOKING THE
LICENSE.

(B)  THE BOARD SHALL ADOPT RULES AND REGULATIONS TO SET
STANDARDS FOR THE IMPOSITION OF PENALTIES UNDER THIS
SECTION.

(C)  THE BOARD SHALL PAY ANY PENALTY COLLECTED UNDER
THIS SECTION INTO THE GENERAL FUND OF THIS STATE.

5-311.1.

(A) IF AFTER A HEARING UNDER § 5-312 OF THIS SUBTITLE
THE BOARD FINDS THAT THERE ARE GROUNDS UNDER § 5-311 OF THIS
SUBTITLE TO SUSPEND OR REVOKE A LICENSE, THE BOARD MAY
IMPOSE A PENALTY NOT EXCEEDING $5,000:

(1) INSTEAD OF SUSPENDING THE LICENSE; OR
