security contributions must be held by a person who is
both a member and eligible to be a member of either the
Teachers' Retirement System or the Teachers' Pension
System; correcting language and punctuation; and
providing that the corrected definition is retroactive
to a certain date.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article - Education
5-202.
(d)(1) (i) EFFECTIVE JULY 1, 1980, [Except] EXCEPT as
otherwise provided in this subsection, "eligible [position]
POSITION" means a position that is held by an employee of
[the] A local board of education or local school system who
is a member [or] AND who is eligible to be a member of the
Teachers' Retirement System [and] OR THE TEACHERS' PENSION
SYSTEM AND:
1. Who performs instructional duties
in a public day school during the normal 10-month school
year as a supervisory teacher, a teacher who is
certificated, a helping teacher, a classroom teacher aide;
or
2. Who holds any other position in a
class that was considered eligible for State payment of
employer contributions for social security under the
standards applied by the Department of Personnel as of
January 11, 1980.
(ii) "Eligible position" does not include
a position held by any employee who is employed under a
federal Comprehensive Employment and Training Act (CETA)
public service program.
(iii) The Department of Personnel shall
adopt rules and regulations that, subject to and consistent
with the above standards, define "eligible position" more
specifically for the purposes of this section.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1981.
