       One of the Attrys of Said County Court of Kent accord
        :ing to the liberties and privilidges accustomed of A plea of
        Trespass upon the Case ~
                And whereupon the Said Michael in his proper prson by
        in prosecution of the accon afd Complaineth and Sayth that
        whereas the Said Testr. in his life time to wit ^in the year of our
        Lord God one thousand Six hundred ninety Eight; one thousand
        Six hundred ninety nine Annd Anno 1700 in Talbot County
        afd within the Jurisdiction of this Court At the Special Instance
        And request of the Said Testator and for the proper use and Ser:
        :vice of him the Said Testatr he the Sd Michael did Severall
        Services paid Severall Sume of Tobacco and delivered Sevrll
        Sums of Mony unto the Said Testatr. in his lifetime As by
        An Account hereunto Annexed and here in Court brought
        the Same appeares Amounting in the whole to the Sum
        One thousand three hundred ninety three pounds of tobo.
        In Consideration Whereof the Said Testatr. in his lifetime
        upon himself Assumed And unto the Said Michaell faithfully
        promised that he the Said Testatr. the afd Sume of
        thirteen hundred ninety three pounds of tobo. unto the
        Said Michaell he would well and truly pay when thereunto
        Afterwards required Yet Notwithstanding the Said Testatr.
        in his life time the thirteen hundred ninety three pds of
        tobacco According to his promise and Assumption unto the
        Said Michaell he would not pay altho’ often demanded ~
        Neither did the Said Mary when Sole after the decease of
        the Said Testatr. pay the Same Altho’ often required (and letters
        Testry in due form of Law Committed &ca.) Neither hath ye:
        Said Henry and Mary nor either of them Since their Inter:
        =Marriage paid the Same altho thereunto often required but
        the Same to pay they and evry of them have denyed and re:
        : fused and Still doth deny and refuse and unjustly detaine
        to the damage of the Said Michaell 2700lb tobo. And there
        :upon he brings this Suit. Earle in prpr prsona plegs &ca. Jno Doe R Roe
