Cepi Corpus pr me John Hawkins Sherff Whereupon ye Sd Deft appears, and bÿ Christopher Phillipson his attrÿ and praÿs this Court for Trÿall. he being a person liveing a great Distance off ~ which being bÿ ye Court heard, and ye pltf being Caled, it is agreed | wch of ye Court ) yt ye pltf attrÿ files his Declan Imediatelÿ, wherebÿ he maÿ make appear his Cause of accõn, wch he Doth in these words fallowing vizt Kent Countÿ-}Ss) in Marÿland } John ffisher of Tallbott Countÿ in Sd Province Planter Stands attached to answr unto William fford of Kent Countÿ afsd Planter of a plea of trespass upon ye Case And whereupon ye Sd William bÿ Michael Earle his Attrÿ Complaines yt whereas ye Sd Wm. on ye 10th Daÿ of March anno Dñi 1701 in Sd Countÿ wthin ye Jursidiction of this Court was poscessed of one Dark baÿ horse wth a mealÿ nose a Slitt in his left Eare and Divers Graÿ haires in his Maine &ca being of his one prpr goods wch Sd horse he ye Sd Wm. out of his Custodÿ & poscession Casuallÿ lost, and afterwards to witt on ye 15th Daÿ of September anno Dñi 1703 bÿ finding Came into ye hands and poscession of him ye Sd Jno yett nevrtheless ye Sd John – not being Ignorant of ye prmisses ye afsd horse unto ye Sd William he hath refused to Deliver allthough to Doe ye Same att Chester river in Sd Countÿ of Kent wthin ye Jurisdiction of this Court on ye 15th Daÿ of 9ber ano Dñi 1704 he ye Sd John was required to Doe ye Same bÿ ye Sd William but ye Same to Doe ye Sd John hath Denÿed and refused and Still Doth Denÿ and refuse and unjustlÿ Detaine to ye Damãge of ye Sd William 30000 he brings this Suite Earle pr qr Pledges &ca John Doe Richard Roe Not Guiltÿ pr patriam Phillipson pr Defts } and ye pltf in Like mañer Earle pr qr ~} Issue Joÿned Whereupon Comãnd is Given to ye Sherf of Kent Countÿ yt he Imediatelÿ Cause to Come here twelve &ca bÿ whom &ca who neither &ca to recognize because as well &ca and ye Sd Sherf makes retn of his Sd prcept and Saÿeth yt he hath here readÿ twelve &ca as bÿ his Sd prcept he was Comãnded |to witt) Thomas Wÿatt.
