      take nothing bÿ his writt afsd but be in mercÿ for his false Clamr. and yt
      the Sd Deft goe thereof wthout Daÿ, It is likewise Considered the Daÿ and
      year afsd yt ye Sd Deft recover agt ye Said pltf as well ye Sume of fiftÿ
      pounds of tobo for a non Suit according to act of assemblÿ as ye Sume
      of one hundred fiftÿ and four pounds of tobacco for his Cost and Charges
      Laid out and Expended according to ye from of ye Statute
