35)    orders And Constitutions of this our province or any of them — in the County
        of Kent afd As According to the form of those laws and orders Shall be
        fit to be done. Wee have also Constituted your or Any four or More of you
        Of which you the Said Mr. Wm. ffrisby Mr. Elias King Capt. John Whitting
        ton Mr. Charles Hynson Capt. Thomas Ringold and Mr. John Salter or
        one of you Shall Allways be one of the Comissioners to enquire by the
        Oathes of good and Lawfull men of your County afd of All manner
        of felonies Witchcrafts Enchantments Sorceries Magick Arts trespasses
        forestallings Engrossings and Extortions Whatsoever And of all and
        Singular other Misdeeds and offences of which Justices of the peace in
        our Kingdom of England May or ought lawfully to Enquire by whom
        :soever or Whatsoever done or perpetrated or which Shall hereafter
        happen to be done or prpetrated in the County afd against the laws
        and orders of this our province, provided that you proceed not in any of
        the cases afd to take life or member but that in every Such case
        You Send the Prisoners with their indictments and the whole Matter
        Depending before you to the next provincial Court to be holden for
        this province whensoever or wheresoever holden thereto be tryed
        And further we do hereby Authorize And Empower you to Issue
        out Writts processe and Attachments and hold plea of Oyer and
        Terminer of all Actions of trespass against the form of any Laws
        or Statutes of our Kingdome of England or the province afd all
        Actions of trespass quare Clausum fregit All Actions of debt and
        Detinue Surtrover and replevin for any Sume or Sums of tobo.
        Mony goods wares or Merchandizes All Accons of Trespasse upon
        the Case for mony tobacco goods wares or Merchandizes or upon note
        book or Account And All other personall Accons of what Nature or
        kind Soever (titles of Land Allways Excepted and foreprized) And after
        Judgt. Execution To award in all causes civill So to be tryed according
        to the laws ordered and reasonable Customes Made and provided in this
        our province of Maryland. In which Causes civill So to be tryed (ex=
        :cepting as before Excepted) We do Constitute ordaine and Appoint you
        the Severall and respective prsons as afd to be Judges as afd And there
        :fore we Command you that you diligently intend the keeping of the
        peace Laws and orders and all and Singular the prmises and that
        At Certaine days Appointed by Act of Assembly in Such case made
        And provided And at the place where your or any four or more of you
        as afd Shall in that behalf Appoint You make Enquiry upon the
        prmises and prform and full fill the Same in form afd doing therein
        What to Justice appertaineth According to the laws and Customs as afd
        And therefore we Command the Sherf of our Sd County by vertue of these
        presents that at the place and on the days afd which you or any
